A Viagra follow-up? Drug used to treat glaucoma actually grows human hair

If you're balding and want your hair to grow back, then here is some good news. A new research report appearing online in The FASEB Journal shows how the FDA-approved glaucoma drug, bimatoprost, causes human hair to regrow. It's been commercially available as a way to lengthen eyelashes, but these data are the first to show that it can actually grow human hair from the scalp.

"We hope this study will lead to the development of a new therapy for balding which should improve the quality of life for many people with hair loss," said Valerie Randall, a researcher involved in the work from the University of Bradford, Bradford, UK. "Further research should increase our understanding of how hair follicles work and thereby allow new therapeutic approaches for many hair growth disorders."

To make this discovery, Randall and colleagues conducted three sets of experiments. Two involved human cells and the other involved mice. The tests on human cells involved using hair follicles growing in organ culture as well as those take directly from the human scalp. In both of these experiments, the scientists found that bimatoprost led to hair growth. The third set of experiments involved applying bimatoprost to the skin of bald spots on mice. As was the case with human cells, the drug caused hair to regrow.

"This discovery could be the long-awaited follow up to Viagra that middle-aged men have been waiting for," said Gerald Weissmann, MD, editor-in-chief of The FASEB Journal. "Given that the drug is already approved for human use and its safety profile is generally understood, this looks like a promising discovery that has been right in front of our eyes the whole time. On to the front of our scalp!"

Silvio Berlusconi faces verdict in tax fraud case

MILAN (AP) ? An Italian court is set to deliver verdicts Friday against former Prime Minister Silvio Berlusconi and 10 others in a six-year-old tax fraud trial.

Prosecutors have demanded a sentence of 3 years and eight months for Berlusconi and three years and four months for the chairman of his Mediaset conglomerate, Fedele Confalonieri.

The verdict comes two days after Berlusconi, 76, announced he will not run for premier in upcoming elections. The three-time premier stepped down last November after Italy came under mounting market pressure to deal with its high debt load and Berlusconi failed to come up with persuasive financial reforms.

Prosecutors allege the defendants were behind a scheme to purchase the rights to broadcast U.S. movies on Berlusconi's private television networks through a series of offshore companies and had falsely declared the payments to avoid taxes.

Prosecutors further allege the inflated the price for the TV rights of some 3,000 films as they relicensed them internally to Berlusconi's networks, pocketing the difference amounting to around ?250 million.

Other charges of false accounting and false statements in financial reports were thrown out because the statute of limitations expired.

Prosecutors also demanded six years for Paolo Del Bue, a founder of the private Swiss bank Arner, who is accused of money laundering, and three years and eight months for Hollywood producer Frank Agrama.

The trial began in July 2006, but was put on hold by a now-defunct immunity law that shielded the Berlusconi from prosecution while he was premier until it was watered down by the constitutional court. The trial also faced delays as Berlusconi cited conflicts with his schedule as premier.

Berlusconi has been tried numerous times for his business dealings. He has always denied wrongdoing and alleged that the cases were politically motivated. In each case to date, he has been cleared or seen the statute of limitations expire.

The statute of limitations in this case is set to expire sometime next year. In Italy, cases must pass two levels of appeal before the verdicts are final.

Berlusconi also is on trial in Milan on charges of paying for sex with an under-age teenager and trying to cover it up.

Google Is Testing Same-Day Delivery - Business Insider

We scoffed when we heard Google was thinking about getting into the same-day delivery business.

But now the New York Times reports that Google has launched a private test of a same-day delivery service in San Francisco, open only to Google employees and their friends.

The reasons why Google wants to get into same-day delivery are complex, but it comes down to this: Much of its advertising revenues comes from e-commerce ads.

The rise of mobile is erasing the distinction between online and offline commerce. And Google wants to get into retail payments, too, with its Google Wallet product.

By getting into delivery, Google knows nearly everything about a transaction, from the search terms that drove the consumer to a particular retailer to the way they paid for the deal to the location where they got the goods.?

The compact 49 square miles of San Francisco are now something of a hotbed for same-day delivery. eBay recently took its same-day delivery service, eBay Now, out of private beta, though it remains limited to San Francisco. TaskRabbit, Postmates, Exec, Instacart and other startups are competing to broker deliveries between retailers and consumers.

Amazon offers limited same-day deliveries in a patchwork of cities and regions across the country, though not in San Francisco. It's widely expected to start offering faster deliveries as it's forced to collect sales taxes on purchases; formerly, Amazon avoided setting up warehouses and other facilities in certain states to avoid being subject to sales-tax regulations.

CLEVELAND, Ohio (October 24, 2012)Hypnosis can help cut hot flashes by as much as 74%, shows a study supported by the National Center for Complementary and Alternative Medicine. This is the first controlled, randomized study of the technique to manage hot flashes, which affect as much as 80% of women who go through menopause. The study was published online this month in Menopause, the journal of the North American Menopause Society.

Controlled, randomized studies may pit an active drug against an inactive placebo pill. But it's hard to find a placebo for mind-body techniques. The researchers at the Mind-Body Medicine Research Laboratory at Baylor University, Waco, TX; the school of Nursing at Indiana University in Indianapolis, IN; and the College of Education at the University of Texas, Austin, met that challenge by randomly assigning the postmenopausal women volunteers to hypnotherapy or "structured attention," which is used as a control intervention with minimal effect.

The women who underwent hypnosis had five weekly sessions in which they received suggestions for mental images of coolness, a safe place, or relaxation, whatever their preference. They also got an audio recording of a hypnotic induction and were asked to practice it daily. The control group had five sessions in which a clinician provided discussion of their symptoms, attentive listening, interpersonal exchange, monitoring, measurement, and encouragement and avoided negative suggestions. The controls also got a recording that they were asked to listen to daily, but this one had information about hot flashes.

All the women kept diaries that tracked hot flash frequency and severity, and they also had hot flash frequency measured objectively by a skin conductance monitor. After 12 weeks, the women who underwent hypnosis reported 75% fewer hot flashes, compared with 13% fewer among the controls, and an 80% reduction in hot flash scores (a combination of frequency and severity), compared with 15% in controls. Skin conductance showed a 57% reduction in hot flashes for the women who underwent hypnosis, compared with 10% in the controls. The hypnosis participants also reported significantly less interference with their lives from hot flashes and better sleep than controls. Moreover, their level of satisfaction with the treatment was high.

How hypnosis eases hot flashes isn't clear. The authors of the study speculated that it may be because hypnosis may improve the function of the parasympathetic nervous system. This system is popularly called the "rest and digest" system, which puts the brakes on the sympathetic or "fight or flight" nervous system that controls body functions that ramp up during hot flashes, such as sweating and heart rate.

ARUSHA, Tanzania - Tourism is one of the most effective ways to preserve Africa?s national parks and protected areas while creating jobs and income for local communities. This was one of the main conclusions of the First Pan-African Conference on Sustainable Tourism in African National Parks, organized by the UN World Tourism Organization (UNWTO) and the government of Tanzania.

?Nature is one of Africa?s greatest assets,? said UNWTO Secretary-General, Taleb Rifai, opening the conference, ?Many of the 50 million international tourists visiting Africa each year are driven by the continent?s unparalleled wildlife and natural scenery. These tourists spend in the local economy, sustain jobs, and provide an incentive for conservation, making tourism a powerful engine for sustainable development.?

The importance of sustainable tourism development for national parks and the people living in and around them was echoed in the Arusha Declaration, adopted by attending tourism ministers, tourism private sector representatives, and conservation officials.

Signatories to the declaration underlined the importance of good governance in managing park tourism, calling for collaborative action among the relevant stakeholders, particularly between public authorities and the private sector. The declaration further stressed ?the need to directly involve local communities in the management of parks and protected areas to ensure they gain concrete benefits in terms of employment and income generation.?

Knowledge exchange between African countries should be prioritized, agreed signatories, given the potential for countries with more limited experience in park tourism to benefit from best practices elsewhere in Africa.

Multi-billion boost for UK supply chain to get business growing

A ground breaking agreement with leading UK companies that will help tens of thousands of businesses secure increased levels of affordable finance was announced by the Prime Minister today, in a move that will support job growth and help aspiring business get ahead.

The Prime Minister today met with the leaders of some of the UK?s largest companies at Downing Street to discuss the important role they play in supporting their supply chains.? As a result of the discussion, the following companies have agreed to boost this support by actively evaluating the implementation of, or continuing to offer, Supply Chain Finance.

Supply Chain Finance (SCF) is an innovative way for large companies to help their supply chain access credit, improve cash-flow and at a much lower cost, and has already been successfully implemented by companies including Rolls Royce and Vodafone.

With Supply Chain Finance a bank is notified by a large company that an invoice has been approved for payment; the bank is then able to offer a 100 per cent immediate advance to the supplier at lower interest rates, knowing the invoice will ultimately be paid by the large company.

Taken together, this means that leading companies could deliver up to as much as ?20 billion of new cheaper, finance to their suppliers, including many UK SMEs.
?
The Prime Minister also announced that the Government will look to, where it can, offer this to its own suppliers, starting with the first UK Government Supply Chain Finance scheme for community pharmacies in England, unlocking up to ?800m of new credit for around 4,500 pharmacy businesses, many of which are SMEs.

The Government believes that this is a major step that could be taken to protect jobs and boost growth, particularly for SMEs, and help our economy compete in the global race.

John Walker, National Chairman, Federation of Small Businesses said:

?The new Supply Chain Finance scheme could help smaller firms in two key areas ? improving their working capital and tackling the issue of late payments. Nearly three quarters of small businesses report that they have been paid late in the past year, placing a huge strain on cash-flow and meaning they struggle to realise ambitions to grow.

?The FSB welcomes the Government?s commitment to helping small firms secure finance. We encourage large companies to support and implement the scheme, so that it can play its part in improving confidence and encouraging growth throughout the supply chain.?

Matthew Fell, CBI Director for Competitive Markets, said:

?Boosting the use of supply chain finance is an innovative way to ease the funding squeeze for many smaller businesses, but it is dependent on the nature of individual supply chains to work effectively so is not a one size fits all solution.

?At the same time larger firms are identifying a variety of different ways to support their supply chains, normally through improved payment terms, direct collaboration and investment.

?It?s encouraging to see the Government leading from the front by setting up its own supply chain finance scheme for NHS pharmacists.?

?The British Bankers? Association supports this initiative and encourages the wider adoption of Supply Chain Finance as part of our continued support for business customers. Banks have for a number of years structured Supply Chain finance programmes for corporates to support the financing needs of their suppliers. The Government is keen to ensure that SMEs have the widest range of credit options available to them and is taking action on a number of fronts to deliver this. This includes:

  • The Funding for Lending scheme to encourage banks to boost lending in the UK economy;
  • The Enterprise Finance Guarantee ? A loan guarantee programme which has helped more than 18,000 small firms obtain bank finance;
  • More than ?160m invested in high-growth UK firm through support for the UK Venture Capital industry;
  • Generous tax schemes for people investing in start-ups and growing companies in UK; and,
  • A new ?82.5m Start-Up loan programme to help young people start their own businesses.

Supply Chain Finance
?
Major UK companies generally have strong credit ratings and excellent access to finance. This contrasts with the SME suppliers to those major UK companies, who often have relatively more expensive finance, and more limited access to equity capital.
?
The largest component of SME financing is ?working capital? funding. SMEs generally fund their working capital via overdrafts, invoice discounting or factoring or similar products.? These products are generally more expensive than their customer?s cost of credit and provide the SME with an advance rate of around 80% ? with the rest coming from equity capital.? This makes it relatively more challenging and expensive for SMEs to grow.
?
With Supply Chain Finance a bank is notified by a large company that an invoice has been approved for payment; the bank is then able to offer a 100 per cent immediate advance to the supplier at lower interest rates based upon their customer?s credit rating (i.e. the major UK company), knowing the invoice will be paid.

The benefits of Supply Chain Finance are:

  • It provides cheap funding to suppliers based on the credit quality of their customers
  • It allows suppliers to receive 100 per cent of the invoice value, less a small finance fee, rather than the 70 to 90 per cent generally offered through traditional finance products for SMEs.? This can help free up money for growth, boost cash-flow or allow businesses to refinance existing debt
  • It can help supply chains to become more efficient as the overall cost of finance is reduced
  • It allows banks to provide finance to SMEs in a significantly more capital efficient manner (which will unlock capital for them to potentially provide yet more lending to SMEs)

SCF was recommended by the Breedon Taskforce on Non-Bank Lending.

Pharmacist scheme:

Community pharmacies dispense around 80 million NHS prescription items every month. They then claim payment from the NHS for the products and services provided.

The amount they are owed is calculated by the NHS Business Services Authority (NHSBSA), but with such high volumes to process, this takes time. Typically, pharmacy contractors receive an estimated 80 per cent of their payment within four weeks of sending their prescriptions to the NHSBSA with the balance being paid the following month. It can therefore take eight weeks before payment is made in full. However in the meantime, suppliers need to be paid and many pharmacy businesses use commercial loans ? which are often expensive ? to maintain cash flow.

In the Supply Chain Finance system, a bank will make the NHSBSA?s estimated payment available to the pharmacist at around day seven. This means they will have access to money more quickly instead of having to wait for the first payment at the end of the month. In accessing the money early, they will need to pay interest, but it will be at a much lower cost than any borrowing arrangement they could usually access.

The Supply Chain Finance scheme could help reduce this cost of borrowing. Around 4,500 pharmacy businesses will be able to get access to approximately ?800 million of credit at a much lower cost than they do now. This means pharmacies will have access to cheap finance to help cover their suppliers? bills.

Study shows overeating impairs brain insulin function, can lead to diabetes and obesity

New research from Mount Sinai School of Medicine sheds light on how overeating can cause a malfunction in brain insulin signaling, and lead to obesity and diabetes. Christoph Buettner, MD, PhD, Associate Professor of Medicine (Endocrinology, Diabetes and Bone Disease) and his research team found that overeating impairs the ability of brain insulin to suppress the breakdown of fat in adipose tissue.

In previous research Dr. Buettner's team established that brain insulin is what suppresses lipolysis, a process during which triglycerides in fat tissue are broken down and fatty acids are released. When lipolysis is unrestrained, fatty acid levels are elevated, which can initiate and worsen obesity and type 2 diabetes. The current study is published online in The Journal of Biological Chemistry. The first study was published in the February 2, 2011 issue of Cell Metabolism.

"We are interested in understanding why people who eat too much eventually develop diabetes. Our recent studies suggest that once you overeat, your brain develops insulin resistance. Since brain insulin controls lipolysis in adipose tissue by reducing sympathetic nervous system outflow to adipose tissue, brain insulin resistance causes increased spillage of fatty acids from adipose tissue into the blood stream," said Dr. Buettner.

Increased fatty acids induce inflammation and that, in turn, can further worsen insulin resistance, which is the core defect in type 2 diabetes. Fatty acids also increase glucose production in the liver which raises blood glucose levels, Dr. Buettner explained. "It's a vicious cycle and while we knew that this can begin with overeating, this study shows that it is really the brain that is harmed first which then starts the downward spiral."

In this study, researchers fed rats a high-fat diet comprised of 10 percent lard for three consecutive days. This increased their daily caloric intake by up to 50 percent compared to the control rats that were fed a regular low fat diet. The researchers then infused a tiny amount of insulin into the brains of both groups of rats that they had shown in earlier studies to suppress release of glucose from the liver and fatty acids from fat tissue. They found that overeating impaired the ability of brain insulin to suppress glucose release from the liver and lipolysis in fat tissue. Similarly, short-term overeating in humans is known to produce comparable insulin resistance which could be explained by brain insulin resistance.

"When you overeat, your brain becomes unresponsive to these important clues such as insulin, which puts you on the road to diabetes. We believe that what happens in rats also happens in humans" said Dr. Buettner.

Dr. Buettner's team plans to investigate methods of improving brain insulin function that could restrain lipolysis and improve insulin resistance.

Climbing in Leavenworth - Intramural Sports - Washington State ...

I had the opportunity to go to Leavenworth this past weekend with some of my more experienced climbing friends for a personal climbing trip. Although it felt a little intimidating to go with people who are way better than I am, I had been asking for months to go on a climbing trip with them, and was not going to pass up the opportunity.

The trip turned out to be a bunch of boys and myself. Being a girl on a ?guys? climbing trip was interesting to say the least, and a whole different kind of fun. As much as I love climbing with my girls, it was a nice balance to get out with the boys. Something about being one of the guys for a weekend does something to center a girl. The boys reminded me to not to take life so seriously, fart and poop jokes are still funny as an adult, and that you definitely need thick skin to hang with the guys.

For several reasons, this trip represents a huge milestone in my climbing journey. I advanced in my climbing experience by lead climbing on traditional gear and climbing my first multi-pitch route. I also learned something new about myself and learned even more about the sport of climbing and what it means to be a climber.

Moving forward with my climbing was not accomplished by my own means. I had an experienced friend, James Higgins*, who set the route and let me top rope climb to get comfortable with the route. He left the gear in place, and on my second pass up the route, I decided to try lead climbing. I don?t think I actually thanked him for taking time out of his climbing on this trip, to help my new friend Emily* and I become better climbers. (So if you?re reading this James thank you, you transformed my thoughts of climbing by taking time to teach me to lead climb.)

This trip was mostly a boy?s trip, so I was relieved to find out another girl, Emily, would be meeting us in Leavenworth. Emily and I, being the only girls, became quick friends. When we started climbing, we realized we had really similar climbing skills, which was awesome considering we were surrounded by amazing climbers. We became each other?s cheerleaders, supporting each other as we challenged ourselves. Emily also completed her first lead climb on the same route.

As good as it felt to overcome a challenge and learn to lead climb, I can?t say me it was accomplished without a moment of doubt. Just as I was getting ready to start my first lead climb, my other really experienced friend, Colt Fetters*, decided this was the proper moment to ask if I was sure I could do it. Though I knew he was just concerned about my safety, I was a little annoyed by his timing. Looking back I am really glad he did. He made me question if I really could do it. Though Emily was cheering me on, at my first clip all I could think was am I really ready to do this?

I decided to trust my own body. Only I know its capabilities and limits, and I was ready to push myself into a new level of climbing. Not only did I trust my own body, I trusted James, to belay me and keep me from falling. My life was in my hands, and if I failed they were in his capable hands. The climb ended up going smoothly, but I took more than just new climbing skills away from this adventure. I left that climb knowing I could trust myself and trust someone else with my life. I was proud I didn?t let my friends? concern talk me out of something I knew I was ready for. Trusting my body and myself made climbing an open door of opportunities that I couldn?t wait to delve into. It made all the climbing adventures I have always dreamed of tangible. I will always remember getting back to the bottom and Higgins telling me that climb was something to be proud of and that he was impressed.

After getting my first taste of what felt like real climbing I couldn?t wait to try every form of this sport I am falling in love with. So when my friend Colt asked if I wanted to try an easy multi-pitch I really had no choice but to say yes.

We decided to climb Midway, a route on Chimney Rock. While Colt and I were preparing for the climb, he explained the tradition of tying into together. It is about recognizing your life is in another person?s hands, and choosing to trust each other. It was humbling to become a part of a sport that was bigger than just me and a friend climbing up a route together. This sport and this rock had history, and being a part of the tradition of multi-pitch climbers made me think. While I was sitting on top of Jello Tower (the top of the first pitch), lead belaying Colt, while he climbed up to the top of the second pitch I had a moment of clarity. I realized that I wanted climbing to be a part of my life forever. I wanted more. Climbing for me is becoming an integral part of my being. It was no longer just a sport to me, but had become an expression of self.

I realized on this trip, a huge part of climbing is the people you choose to climb with; the people you choose to trust with your life and to learn from as climbers and as friends. Climbing is not just about getting to the top of some rock, it?s spreading the knowledge. People don?t just become climbers, they are taught those skills by other climbers. It is about ?Spreading the stoke? as Higgins would say. Those who taught me all these great new skills learned from someone else, and one day I hope to pass it on and teach others to climb.

I asked everyone on the trip when you get to call yourself a real climber. And I think my friend James Ellis* summed it up simply and beautifully. James said that ?being a real climber isn?t about how hard you climb or how many climbs or summits you have under your belt. Being a climber isn?t an option, you don?t want to climb you have to climb.?

I don?t know if I?m there yet, but I know my body craves climbing. My subconscious dreams about it and I love the sport. So here?s to exploring my climbing addiction.

Maine innovation on display at Colisee in Lewiston ? Business ...

LEWISTON, Maine ? It was like the brainiest party you?d ever seen: Roughly 400 people crowded into the Androscoggin Bank Colisee to sip wine, eat cheese and exchange ideas.

Really big ideas.

For the first time, The Maine Technology Institute held its Innovation Economy showcase in Lewiston and the turnout was huge. Hundreds came to see and hear the latest in matters such as renewable energy, communications, biotechnology and manufacturing.

?It?s just amazing,? said MTI President Robert Martin, ?the reach and breadth of what Maine companies can do.?

There was a lot of life-changing technology on display, but one of the busiest booths around was more in the realm of leisure. This belonged to Pantheon Guitars, a Lewiston company that had segments of its high-end acoustic guitars on display.

The booth was busy almost at once. Even the nerdiest people admittedly don?t know how a guitar is made.

?That,? said Pantheon CEO John D. Karp, ?is part of the fun.?

Like all other businesses on display at the show, Pantheon has benefited from MTI, which since 2000 has awarded $142 million in grants and loans to Maine companies and research institutions.

?I?m a huge fan,? Karp said. ?They really helped us to make advances in our processes.?

A few booths down stood the people of Falcon Performance Footwear, an Auburn company. It also has received grants from MTI to help with development. In response to that, it put on display a boot, sliced down the middle to show its many parts.

The booth was manned by Carl Spang. As Falcon president, he doesn?t get out to mingle very often with other innovators.

?It?s great to be out at a local show and to see all these people,? Spang said.

Around the corner was Packgen, an Auburn company that manufactures containers made from composite materials. It, too, benefited from an MTI grant and as a result, it expects to create a dozen additional jobs in the coming year.

The show was about innovation, but it wasn?t as tech-heavy as it could have been. Men in coats and ties mingled with women in power suits. They drank beer and wine and gathered in small groups, talking shop or discussing the state of innovation in Maine.

Which was precisely the point.

?We have these great companies in the state, but you don?t see them; they?re tucked away here and there,? MTI spokeswoman Deborah Cook said. ?This is a chance for us to make all of this visible.?

Gov. Paul LePage, citing illness, failed to show to deliver a speech, but that didn?t quiet the enthusiasm of the gathering. Other speakers took his place, including David Kappos, undersecretary of commerce for intellectual property and director of the U.S. Patent and Trademark Office, and Desh Deshpande, a Boston venture capitalist and entrepreneur.

With gasoline scaling $4 a gallon recently,?plans announced last week by international oil giant BP to export U.S.-produced crude oil?ought to have Americans howling. For such a plan to be good energy policy--rather than merely profitable for the oil industry--the United States would have to be producing more than enough oil to meet its own needs. But the country produces nowhere near that amount. Nevertheless, the industry's deceptive campaign to make the public and policymakers believe that the United States is on the verge of energy independence seems to be succeeding--a push that is really just a smokescreen for selling the country's oil and natural gas to the highest bidder.?

So far this year the United States has produced?6.2 million barrels per day (mbpd) of crude oil plus lease condensate (which is the definition of oil)?versus daily net consumption of 13.6 mbpd of finished petroleum products. The country is a long way from being free of oil imports, and as I'll discuss below, there is no realistic prospect that we'll ever produce enough oil domestically to satisfy our needs at the current level of consumption.?

Chelsea Clinton visits Nigeria on health mission

ABUJA, Nigeria (AP) ? Chelsea Clinton, the daughter of the former U.S. president and the current U.S. Secretary of State, visits Nigeria's capital as part of a trip organized by her father's foundation.

Clinton visited Nigeria's Aso Rock presidential villa on Tuesday and met with President Goodluck Jonathan. She later spoke about the Clinton Health Access Initiative and its efforts to reduce child mortality in Nigeria, an oil-rich but poverty-stricken nation.

Clinton said she supported efforts to increase health coverage in Nigeria. She also lauded work being done to end diarrhea-related deaths of children in Nigeria by distributing rehydration tablets. The Clinton Health Access Initiative estimates making the tablets available to children could help prevent as many as 220,000 child deaths a year in Nigeria.

Federal Circuit Rejects Galaxy Nexus Preliminary Injunction Finding No Irreparable Harm Despite a Market Shift.

This case is important because it further reduces the chances that the owner of a component patent will obtain injunctive relief.

Patent litigation is fairly slow and often takes years for a case to proceed through trial and appeal. One shortcut to action is a motion for preliminary injunction. Such a motion asks a court to exert its equitable power to immediately stop the harm of ongoing infringement ? even before ultimately concluding that the patent is valid, enforceable and infringed. Following an extension of eBay v. MercExchange, courts require a patentee to satisfy a four-factor test before granting injunctive relief.

A plaintiff seeking a preliminary injunction must establish that he is likely to succeed on the merits, that he is likely to suffer irreparable harm in the absence of preliminary relief, that the balance of equities tips in his favor, and that an injunction is in the public interest."

Generally, these preliminary injunction factors can be thought of as being identical to the eBay permanent injunction factors with the addition of having to prove the likelihood of success on the merits. (In a permanent injunction scenario, the merits have already been decided.) An important aspect of preliminary injunctions in patent cases is that they are immediately appealable as a matter of right. This right of immediate appeal is different from almost every other district court decision except for the ultimate dismissal of the case.

In this case, Judge Koh issued a preliminary injunction ordering Samsung to stop sales of its Galaxy Nexus smartphone based upon the likelihood of its infringement of Apple's Patent No. 8,086,604. I should pause for a moment to note that this case is different from the parallel Apple v. Samsung case that resulted in a $1b jury verdict for Apple that is currently being challenged by Samsung. The patent in the case-at-hand is related to Google's Siri system that uses a set of heuristic modules for searching various types of information.

On appeal, the Federal Circuit has vacated Judge Koh's decision ? finding that the district court "abused its discretion" in issuing the injunctive order favoring Apple. The court found two basic problems: (1) that Apple had failed to prove irreparable particularly linked to Samsung's use of this particular invention; (2) that the district court had construed the asserted claims too broadly with the result being that Apple probably cannot prove infringement. Either of these issues would be sufficient to reject the preliminary injunction.

In discussions of injunctive relief, this opinion will likely be termed Apple II in order to distinguish it from the federal circuit Apple v. Samsung decision issued earlier this year in Apple, Inc. v. Samsung Electronics Co., 678 F.3d 1314, 1325 (Fed. Cir. 2012) (hereinafter Apple I). Both decisions build on the nexus analysis that links the patented invention to the alleged irreparable harm ? "that a sufficiently strong causal nexus relates the alleged harm to the alleged infringement."

This nexus analysis for irreparable harm is parallel to that employed in other areas of patent law such as consideration of secondary factors of non-obviousness and in proving lost profits. This development obviously makes it much more difficult to obtain injunctive relief in the typical high-tech scenario where a retail product includes thousands of small innovations that each contribute incrementally to the ultimate value of a product.

In Apple I, the court described the law as follows:

To show irreparable harm, it is necessary to show that the infringement caused harm in the first place. Sales lost to an infringing product cannot irreparably harm a patentee if consumers buy that product for reasons other than the patented feature. If the patented feature does not drive the demand for the product, sales would be lost even if the offending feature were absent from the accused product. Thus, a likelihood of irreparable harm cannot be shown if sales would be lost regardless of the infringing conduct.

In Apple II the court continues:

In other words, it may very well be that the accused product would sell almost as well without incorporating the patented feature. And in that case, even if the competitive injury that results from selling the accused device is substantial, the harm that flows from the alleged infringement (the only harm that should count) is not. Thus, the causal nexus inquiry is indeed part of the irreparable harm calculus: it informs whether the patentee's allegations of irreparable harm are pertinent to the injunctive relief analysis, or whether the patentee seeks to leverage its patent for competitive gain beyond that which the inventive contribution and value of the patent warrant.

It only follows that the causal nexus analysis is not a true or false inquiry. The relevant question is not whether there is some causal relationship between the asserted injury and the infringing conduct, but to what extent the harm resulting from selling the accused product can be ascribed to the infringement. It is not enough for the patentee to establish some insubstantial connection between the alleged harm and the infringement and check the causal nexus requirement off the list. The patentee must rather show that the infringing feature drives consumer demand for the accused product. Only viewed through the prism of the causal nexus analysis will the irreparable harm allegations reflect a realistic sense of what the patentee has at stake.

Here, Apple proved that its Siri application (also covered by the patent) is popular and also that demand for the Galaxy Nexus had come at the expense of iPhone purchases. However, the court found that Apple failed to show that the customer demand for Galaxy Nexus was driven by its allegedly infringing feature. Without proving that link, the court could not find that the (alleged) infringement caused irreparable harm.

Apple I was decided by Judges Bryson and Prost with a partial dissent by Judge O'Malley (concurring on this issue). This case, Apple II was decided by Judges Prost, Moore, and Reyna acting unanimously.

Taken as a pair, Apple I and Apple II are important because they further reduce the chances that the owner of a component patent will obtain injunctive relief. Before eBay, irreparably harm was hardly a consideration. Since eBay, the irreparable harm factor has largely focused on whether the patentee has a product or potential product being harmed by ongoing infringement. Now, the question will move to the next level of granularity in a way that will be difficult for patentees to prove.

Dealing with a work crush - Relationships, Dating, & Marriage

Q: Several years ago I was quite smitten with a guy at work. But because he didn?t feel quite the same, we only developed a friendly non-physical relationship. He left the company and in time I was able to put it behind me. He recently returned to the company and I find that my feelings for him have been reawakened. Despite my several attempts to reconnect with him in a friendly way, he responds in only a polite and somewhat distant manner. This is really painful to me and is messing me up. We work in somewhat close proximity and it is unavoidable that I see him on a regular basis. I don?t see a way out of this situation. Leaving the job is not a possibility and every time I see him it hurts more and more. Do I ask him why he is acting this way and try to get some closure? Just start avoiding him to protect myself? What do I do?

If it becomes unbearable and he?s actually being mean, you can have the talk. But for now, just try to keep him in perspective. You have other friends at work. You didn?t need him while he was gone and you don?t need him now. I?d rather him keep his distance than mess with your head.

NBA schedule: Reformed Lakers make preseason debut, minus Dwight Howard

The new look Los Angeles Lakers will make their preseason debut on Sunday, but without their prized offseason acquisition in big man Dwight Howard

Kobe Bryant will lead his revamped Los Angeles Lakers team in their preseason debut against the Golden State Warriors on Sunday, highlighting one of Sunday's five preseason games.

The Lakers will take on the young Warriors squad at 10 p.m ET. Sunday from the Save Mart Arena in Fresno, Calif. While the reformed Lakers will be making their preseason debut on Sunday, they will need to do it without their prized offseason acquisition in center Dwight Howard, who is still recovering from back surgery.

Other games on the Sunday schedule include the New Orleans Hornets hosting the Orlando Magic at 2:30 p.m ET from Mexico City. The game can be seen on NBA TV. Geopolitics, resources put maritime disputes back on map

WASHINGTON (Reuters) - Small and occupied largely by seabirds, goats and a unique indigenous species of mole, the islands named Senaku by Japan and Diaoyu by China have long been largely ignored.

But as rising powers face off against each other in a battle not just for influence but also vital resources, such disputed islets, reefs, and areas of seabed are swiftly growing in importance; and not just in Asia.

From the melting and resource-rich Arctic to the eastern Mediterranean, the South Atlantic to the East China Sea, legal wrangling, diplomatic posturing and military saber rattling are all on the rise.

The current row between Beijing and Tokyo over five islets and three rocks seems one of the riskiest so far, putting two of Asia's most powerful states at loggerheads - although most experts believe talk of outright war is overstated for now.

"Some of these lines have always been disputed," says Admiral Gary Roughead, a former US Pacific Fleet commander who retired as Navy Chief of Operations last year and is now Annenberg distinguished fellow at Stanford University's Hoover Institute.

"But the resource issue is giving them much greater edge. You have energy reserves, you have fish stocks - which are particularly essential to the Asian diet and which I think we too often ignore - and increasingly you are going to have interest in undersea minerals and rare earths."

What began as a purely diplomatic row when Japan's government bought land on the islands from their private owner has escalated to so far bloodless confrontations between patrol boats and fishing craft. Last week, Taiwan - which also claims the islands and with them hundreds of square sea miles believed to contain considerable gas and oil - entered the fray as its own patrol craft and fishing boats entered the waters.

"These disputes are definitely coming back into fashion," says Eric Thompson, head of strategic studies at the Centre for Naval Analyses, which provides analysis to the U.S. Navy and Pentagon amongst other clients as part of larger US-government funded think tank CNA.

"You have profound geopolitical shifts... that are making certain states much more politically, economically and militarily more assertive. Then, you have new technologies that are putting resources within reach that would have been either unknown or impossible to access only a few years ago."

Not all states resort to direct action. Later this year, Chile and Peru will go to the International Court of Justice to determine the exact location of their maritime boundary while Bangladesh and Myanmar went through a similar process at the Hamburg-based tribunal that arbitrates the United Nations Convention on Law of the Sea (UNCLOS).

Argentina might be raising its rhetoric once again over what it calls the Malvinas and Britain calls the Falklands, but most diplomats believe it plans a diplomatic campaign rather than the kind of direct assault they launched in 1982.

But in a growing number of cases, fishing boats, oil and gas exploration vessels and sometimes aircraft and warships find themselves in increasing if so far largely bloodless confrontation.

Even areas so far unaffected, such as Africa's coastal waters, could soon also see mounting disputes as oil and gas finds pit neighboring nations against each other.

"Launching land wars to seize resources is no longer seen as acceptable," says Nikolas Gvosdev, professor of national security studies at the US Naval War College. "But a grab for resources at sea may be a different matter."

"HOW MUCH IS DISPUTED? PRETTY MUCH ALL OF IT"

On a map of the eastern Mediterranean, CNA strategy expert Thompson sketched out a block in the waters between Turkey, Cyprus, Israel and Lebanon - the sight of a potentially huge gas find first identified in 2009.

"It's enough to meet almost the entire world's energy requirements for almost a year," he told Reuters on a visit to the Centre for Naval Analyses in Alexandria, Virginia earlier this year. "How much is disputed? Pretty much all of it."

Last year, both Turkey and the government of Cyprus sent warships out alongside exploration vessels, ratcheting up tensions that had been easing since a 1974 war left Cyprus divided. Already increasingly asserting itself as a Mediterranean power, Turkey has made it clear it backs claims by the Turkish Cypriot enclave that occupies the island's north.

Rivalry over gas looks to have further complicated the already increasingly acerbic relationship between one-time allies Turkey and Israel. Defense sources say the two countries' jets now periodically face off over the contested waters, although some believe all sides have been more restrained this year in part by preoccupation with events in nearby Syria.

Even if such conflicts never spark open warfare, analysts say they can fuel wider regional tensions, arms races and potentially raise the risk of wars over other issues.

That could be amongst the greatest danger from China's grandiose maritime claims, which have put it at loggerheads with almost every other regional power. While Beijing has become more assertive, foreign officials and other observers say other Asian states are following suit.

Japan's focus on its territorial dispute, for example, is seen suggesting a very different approach to foreign policy than that usually followed by Tokyo since 1945.

The most complex of China's disputes, over the oil-rich Spratly Islands, also wraps in the Philippines, Vietnam and Taiwan. All have stepped up sea and air patrols as well as garrisoning isolated atolls and floating patrol bases.

HIGH STAKES, LITTLE AGREEMENT

Senior officials make it clear Washington would rather not be dragged in. Chief of Naval Operations Admiral Jonathan Greenert told reporters on Thursday that China and Japan needed to work out their differences on their own.

"We've been very clear that these bilateral disagreements have to be worked out with the countries involved," Greenert said after a speech to the Association of the U.S. Navy.

But the U.S. might struggle to stay on the sidelines, particularly given its alliances with Japan and other regional powers - almost all with disputes with China.

"By the very nature of our global presence, we are going to end up becoming involved," Greenert's predecessor Roughead told Reuters. "We are going to need to use our influence to push for peaceful solutions. But there are going to be challenges."

The irony, resorts experts say, is that for companies to be willing to exploit the riches under the sea they will almost invariably require disputes resolved and conflict risks gone.

But in times of economic headwinds, nationalistic rhetoric and posturing can seem an appealing distraction. Certainly, those trying to resolve such issues say it is getting harder.

"The higher the stakes, the more difficult it is," says Lawrence Martin, a Washington DC-based maritime lawyer advising governments at law firm Foley Hoag.

"Some of the states have domestic politics that makes it very difficult to back down."

In principle, any such dispute should be arbitrated under the UN Convention UNCLOS, introduced in 1982 and ratified by most countries. The United States, however, has never signed, despite pleas by a succession of presidents, secretaries of state and defense and military chiefs to overcome objections from Congress where some members see it as overly restrictive.

The paradox, US experts in particular say, is that Washington has tended to follow the convention almost to the letter when making its own claims, while several states who have ratified it - most notably China - appeared to ignore it.

"What we are seeing with these disputes is something we see in a lot of other areas as well," says Jonathan Wood, global issues analyst at London-based consultancy Control Risks. "It's increasingly rare to have global consensus on how to manage difficult issues. And when you think of how a single YouTube video can stir up demonstrations and riots, you can never guarantee these things will not get out of control."
